Accommodations: Inbound Cuba offers superior accommodations, or best available in areas where superior accommodations are not an option. Inbound Cuba reserves the right to substitute accommodations when necessary. Bedding types & special requests should be made at time of reservations but cannot be guaranteed.
Meals: Meals & beverages are included as indicated in each itinerary. Two beverages (local beer, local cocktail, soda, or bottled water) are included with included lunches and dinners. Additional beverages are at the traveler’s expense, including wine.
Guides: The services of local and national guides are included as indicated in each itinerary. In certain circumstances, the guide may also be the assigned driver for a tour and defined accordingly within the itinerary.
Sightseeing: English speaking guides will facilitate all guided sightseeing. Entrance fees are included for sights visited, unless otherwise prohibited by specific venues or noted as optional.
Luggage & Porterage: Luggage charges incurred from international and local airlines are the sole responsibility of the traveler. Additional porterage charges at airports and hotels are the responsibility of the travelers.
Exclusions: Air transportation; airport taxes; passports and visa expenses; laundry, and all items of a personal nature; expenses of guides and/or vehicles for sightseeing not included in the itinerary; health, accident, baggage, and trip cancellation insurance; some gratuities; and other items not mentioned as being included.
Gratuities: Gratuities are included for specialty guides during included excursions, and restaurant servers on included meals. Hotel maid gratuities are not included. Gratuities for Inbound Cuba’s tour guide and driver are not included, and at the traveler’s discretion.
Recommended Tour Guide and Driver Gratuity: $10 CUC for Tour Guide and $7 CUC for Driver – per person, per day.
Reservations & Payments: Deposit, and all additional payments may be made by credit card, check, or bank transfer to Terraversed, LLC.
Inbound Cuba Payment Policy: Inbound Cuba is a wholly-owned division of Terraversed, LLC. All checks, credit card payments, and wire transfers are processed through our parent company. Below is a summary of our payment policy.
Confirming Outside of 61 days: $300 per person deposit with final payment due 60 days prior to arrival.
Confirming 60 days or less: Total booking cost due at time of confirmation
Cancellation Policy: The below cancellation policy is applicable to all tours, extensions and travel arrangements provided by Inbound Cuba. Written notification of cancellation must be provided within the prescribed days prior to departure as per schedule detailed below:
61 or more days prior to arrival: $200 USD per person cancellation fee
60 to 15 days prior to arrival: 50% of total costs is non-refundable
14 days or less prior to arrival: 100% of total costs is non-refundable
** Special payment or cancellation terms may apply during special events or at specific accommodations. Terms will be discussed at time of quotation to ensure travelers are fully aware.
Changes by Traveler(s): Changes, additions and modifications made to any portion of your tour, both before and after departure, are at the traveler’s expense. Payment for these modifications must be arranged with the local operator. Refunds will not be paid for services arranged prior to departure and not utilized by traveler(s).
Unused Services: Refunds will not be paid for services arranged prior to departure and not utilized by traveler(s).
Travel insurance: It is advisable to get travel insurance at the time of booking your trip, since coverage will begin for pre-departure cancelation from the policy issue date. This will, therefore, provide coverage should you have to cancel your trip for an insured (covered) reason.
We strongly recommend that you and all members of your party are adequately insured, protecting against unforeseen circumstances that could otherwise spoil your travels. Coverage should include medical expenses and repatriation in the event of accident or illness. In addition, we also strongly recommend that you have coverage for personal belongings, delay at your outward or homeward point of departure, personal liability, overseas legal expenses and cancellation. If you are undertaking any sports or adventurous activities, including trekking, on your trip you should also make sure that your policy covers these. Please also ensure you read the policy conditions and exclusions.
Changes by Inbound Cuba: Inbound Cuba starts planning the trips we offer many months in advance. Occasionally, we have to make changes to itineraries, hotels and other details both before and after bookings have been confirmed. While we always endeavor to avoid changes and cancellations, we must reserve the right to do so.
However, we will only cancel your confirmed booking after balance due date where you have failed to comply with any requirement of these booking conditions entitling us to cancel (such as paying on time) or where we are forced to do so as a result of ‘force majeure’ as defined herein. We will not cancel after this date for any other reason.
Cancellations: Inbound Cuba does its best to operate all tours listed, but many operational circumstances and program aspects are outside of our control, and as such, we reserve the right to cancel a program at any time for any reason. Should a program be cancelled or inoperative, we will inform you as soon as possible about the cancellation. Inbound Cuba is not responsible for additional expenses that may occur as a result of the cancellation of a program, such as airline cancellation fees, visa fees, vaccinations, purchases of clothing or equipment for the cancelled program or other expenses.
Pricing and Changes: Tour prices include planning, handling and operational charges are based on current rates of exchange at the time of your confirmation. Up to the date of departure, Inbound Cuba reserves the right to increase tour prices and without notice, to withdraw any part or the entire trip, and to make such changes as may be necessary, and the resulting extra cost, if any, shall be paid by the tour members.
Surcharges: Significant increases in aviation fuel and other energy prices as well as fluctuations in exchange rates and other factors may necessitate an increase in trip prices before or after you book. Inbound Cuba reserves the right to surcharge for tour component increases even after final payment. We reserve the right to make changes to and correct errors in quoted prices at any time before your trip is confirmed.
Health: It is essential that you see your physician before booking your trip and before traveling to make sure that you have taken all the necessary health precautions. Some vaccinations require more than one visit with a period of weeks between injections. You should visit your doctor at least six weeks before departure. For up to date medical advice you may wish to use the Center for Disease Control and Prevention (CDC). It maintains a travelers’ health page: wwwnc.cdc.gov/travel/destination.
Inbound Cuba Tours generally require participants to be in good physical and mental health. Inbound Cuba will make reasonable efforts to accommodate the special needs of its travelers; however, such travelers should be aware that the Americans with Disabilities Act is inapplicable outside of the United States. Facilities outside the United States for disabled individuals are limited. Accordingly, when you reserve your tour, please inform Inbound Cuba of any physical disabilities or limitations so that we can help you determine the appropriateness of the itinerary you select. Notwithstanding the foregoing, Inbound Cuba reserves the right to decline to accept or retain on any trip any person as a passenger should such person’s health or mental condition or physical infirmity or general deportment impede the operation of the trip or affect the rights, welfare, health, safety or enjoyment of other passengers. Refund of unused land services is the limit of Inbound Cuba’s liability in such an event. It is the guest’s responsibility to judge the appropriateness of these travel activities to their physical capabilities. At times, the vendors with whom Inbound Cuba contracts may require a doctor’s release to travel for travelers of a certain age or with special disabilities.
Smoking: At the request of the majority of our clients we do not allow smoking on any form of transportation used for our tours. Stops are regularly made where you will be able to smoke.
Hotel information: There is frequent confusion over the terminology used for bed arrangements in hotel rooms. A “double” is recognized as meaning a room with a double bed, which may be two single beds pushed together. A “twin” is a room with two single beds. Please note that all rooms are allocated at the discretion of the hotel and cannot be guaranteed.
Single rooms tend to be smaller than double or twin rooms; however, many hotels do not have single rooms, in which case you will be allocated a twin or double room.
Special dietary requirements: Special diets should be requested on the booking form; however, it is unrealistic to expect special diets to be catered to in Cuba. We will advise the restaurants and accommodation providers of your request, but we cannot guarantee their availability.
Passport, visa & traveling abroad information for US Citizens: Travelers must hold a passport which is valid for at least six months following the return date of your tour. US citizens currently require a Cuban tourist card, purchased from your air travel provider. For up to date visa requirements, visit www.travel.state.gov
Citizens of other countries should check with the relevant embassy in their own country.
You are responsible for obtaining any travel documents and/or verifying entry requirements necessary for Cuba and/or countries you transit during your travels. Entry laws differ with respect to each traveler’s citizenship. Inbound Cuba will not obtain personal travel documents for customers or assume responsibilities for notice of countries’ current requirements. You are responsible for any expenses incurred as a result of the delays or itinerary changes related to your lack of appropriate travel documents.
Data Protection: We will hold your name, address and any other details you supply us with on our database. This information will be used to make your travel arrangements and to send you information about Inbound Cuba. In order to make your travel arrangements, we may need to pass your details to companies and individuals in countries where less stringent data protection controls may be in place. We will not pass on your details to third parties for any other purposes.
California Seller of Travel: Please be advised California has established a Travel Consumer Restitution Fund. It does not cover non-California residents, and even in the case of California residents, does not cover any foreign travel where the foreign “providers of transportation of travel services” are not in compliance with the seller of travel law (compliance being defined as: registered as a seller of travel in California and a participant in the travel Consumer Restitution fund). Thus, none of the trips offered qualify and by law you are required to be advised that you would not be eligible to make any claim from that fund in the unlikely event of default by Inbound Cuba, or any of our foreign suppliers. California Seller of Travel registration #2121484-40. Registration as a seller of travel does not constitute approval by the State of California.
Severability: The invalidity or enforceability of any part of this Agreement, or the invalidity of its application to a specific situation or circumstance, shall not affect the validity of the remainder of this Agreement, or its application to other situations or circumstances. Any provision of this Agreement held invalid or unenforceable only in part or degree will remain in full force and effect to the extent not held invalid or unenforceable.
Waiver: Any failure by either party at any time, or from time to time, to enforce or to require the strict keeping and performance of any of the terms or conditions of this Agreement shall not constitute a waiver of any such terms or conditions and shall not affect or impair such terms and conditions in any way or the right of such party at any time to avail itself of such remedies as it has for the breach or breaches of such terms and conditions.
Release, Assumption of Risk and Binding Arbitration Agreement: Please, read the following conditions carefully. All trips sold by Inbound Cuba are subject to these conditions and the other general information in this booklet.
Inbound Cuba, whose headquarters are in Safety Harbor, FL, United States, its subsidiaries, owners, directors, officers, employees and affiliates, (collectively “Inbound Cuba”), does not own or operate any entity which is to or does provide goods or services for your trip including, for example, ownership or control over hotels or other lodging facilities, airlines, vessels, buses, vans or other transportation companies, local ground operators, providers or organizers of optional excursions or equipment used thereon, food service or entertainment providers, etc. All such persons and entities are independent contractors. As a result, Inbound Cuba is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party. Without limitation, Inbound Cuba is not responsible for any injury, loss, or damage to person, property or luggage, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as scuba diving, zip lining, snorkeling, paddle boarding, swimming, kayaking, sailing, canoeing, rafting, hiking, bicycling, rock climbing, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics or the threat thereof or for any other cause beyond the direct control of Inbound Cuba.
Photography on Tour: Inbound Cuba reserves the right to take photographs and/or videos during the operation of any tour, and to use the photography for promotional purposes. Participants who prefer that their image not be used are asked to make this request known to Inbound Cuba in writing during the booking process.
Assumption of Risk: I am aware that adventure travel such as that I am undertaking involves hazardous activities, some in remote areas of Cuba with a risk of illness, injury or death which may be caused by forces of nature, animals, insects or flora, the negligence of Inbound Cuba, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. I am aware that weather conditions may be severe, adverse and/or unpleasant. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating on the trip. In order to partake of the enjoyment and excitement of this adventure travel trip, I am willing to accept the risks and uncertainty involved as being an integral part of my adventure. I hereby accept and assume full responsibility for any and all risks of illness, injury or death and of the negligence of Inbound Cuba or of any third parties.
Voluntary Participation: I acknowledge that I have voluntarily applied to participate on the trip designated on my confirmation (or a trip which I may change to) and that I have read the description of the trip as it appears in the current Inbound Cuba documents relating to the trip, together with all information contained in my tour documents. I am voluntarily participating in this trip with knowledge of the hazards involved. I am also aware that additional waivers may be required by local tour providers in order to participate in certain activities during my trip.
Binding Arbitration: You hereby agree that any dispute concerning, relating or referring to this Agreement, the brochure / flier/ website/ invoice or any other literature concerning your trip, the trip itself or any claim for damages due to injury or death which occurs during or in connection with the trip shall be resolved exclusively by binding arbitration according to the then existing rules of the American Arbitration Association in an arbitration conducted in Florida, U.S.A. Such proceedings will be governed by the substantive law of the State of Florida. The dispute will be resolved by a single arbitrator who must be a lawyer admitted to practice in the courts of at least one state in the United States and have a minimum of fifteen years of experience in civil litigation. The arbitrator so described will be selected by the American Arbitration Association. Each party to the dispute shall have the right on a single occasion to veto the designation of an arbitrator so selected. There will be judicial review of the arbitrator’s decision if either side can show plain error in the application of law or be able to show an abuse of discretion with respect to factual findings. The parties waive the right to rely on any state law or statute which creates an exception to enforcement of the requirement that disputes be resolved pursuant to arbitration in the manner set forth herein.
Jury Trial: In connection with any action or legal proceeding arising out of this agreement, the parties hereby specifically and knowingly waive any rights that either party might have to demand a jury trial.
Force majeure: We cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected, or you otherwise suffer any loss, injury, death, inconvenience or damage as a result of circumstances amounting to ‘force majeure’. In these terms and conditions ‘force majeure’ means any event or circumstances which we or the supplier of the services in question could not foresee or avoid, acting reasonably. Such events and circumstances may include, actual or threatened, war, insurrection, riots, strikes, civil action, decisions by governments or governing authority, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers, terrorist activity or the threat thereof, industrial action, natural or nuclear activity, epidemics/pandemics or the threat thereof, adverse weather conditions, fire and all similar events outside our control.
Flights and your responsibility: We can accept no responsibility if you arrive late for the check in and miss your flight as a result nor can we accept responsibility for any loss by you of your trip/flight travel tickets, vouchers or coupons.
We and our local ground-handlers reserve the right to remove you from any trip if you endanger yourself or others or disrupt the general well-being of the trip itself. In any such case, there will be no refund. When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must ensure that all your travel documents, full passports, visas, vaccination certificates, currency and travelers cheques are in order and valid for travel. All costs incurred in obtaining such documentation must be paid by you. We cannot accept liability if you are refused entry onto any transport or into any country due to failure on your part to carry correct documentation.
Exclusivity: Except as otherwise expressly provided to the contrary, the rights herein granted, and this Agreement are for the benefit of the parties hereto. The terms and conditions of this Agreement shall be exclusive of any advertising, marketing or other sales literature or activities of Inbound Cuba and nothing contained in any of such materials shall be construed to create any rights as a result of or in connection with this Agreement.
YOU SPECIFICALLY UNDERSTAND THAT YOU ARE RELEASING, DISCHARGING AND WAIVING ANY CLAIMS OR ACTIONS THAT YOU MAY HAVE PRESENTLY OR IN THE FUTURE FOR THE NEGLIGENT ACTS OR CONDUCT OF THE OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS OR SUBCONTRACTORS OF INBOUND CUBA.
EXPRESS WAIVER OF ANY RIGHT TO SEEK CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES
Regardless of the situation or circumstances giving rise to a claim, you waive any right to seek consequential, punitive or exemplary damages against Inbound Cuba its owners, officers, directors, agents, contractors, subcontractors and employees, for any reason whatsoever. In consideration of participating in my vacation package, my signature on my tour agreement indicates that I have, on the date shown, read and understood this document and I acknowledge that it affects my legal rights and agree to be bound by its terms. My signature also signifies my intention to relieve and indemnify Inbound Cuba, its owners, officers, directors, employees, agents, contractors and subcontractors from any liability for personal injury, property damage or wrongful death which I might suffer during my participation in the scheduled tour package.
Time Limitation: You agree that no suit, whether brought in rem or in person, shall be maintained against Inbound Cuba for emotional or physical injury, illness or death unless written notice of the claim, including a complete factual account of the basis of such claim, is delivered to Inbound Cuba within 185 calendar days from the date of the incident giving rise to such injury, illness or death; and no suit shall be maintainable unless commenced within one (1) year from the day of the incident giving rise to such injury, illness or death, notwithstanding any provision of law of any state or country to the contrary.
Indemnity: You agree to indemnify, hold harmless, and defend Inbound Cuba against any damage, liability, suit, claim, penalty, fine, cost or expense whatsoever which arises out of your negligence or caused by your breach of these Terms and Conditions, or which results from your acts, omissions or defaults or any person acting on your behalf, or which results from the acts, omissions or defaults of, or any claims asserted by, the other participants on the trip.
Complaints: Should you have any complaints about any aspect of your travel arrangements, you must inform our local representative or Tour Guide immediately and the supplier of the arrangements concerned. Problems can most easily be dealt with on the pot. Please note, if you do not report a problem or complaint which, if it had been reported at the time it occurred could have been resolved there and then, we cannot accept any liability in respect of that problem or complaint. It is sensible to expect a client traveling in the developing world to be reasonably resourceful if things go wrong. If you experience any difficulties, contact us or our In-Country Concierge 24/7. The number is pre-programmed into the local mobile phone provided upon your arrival into Cuba. In the unlikely event that an acceptable solution cannot be found, you should then write to us within 28 days of your return with full details of your complaint.
Special requests: If you have any special request, you must advise us at the time of booking. Although we will endeavor to pass any reasonable requests on to the relevant supplier, we regret we cannot guarantee any request will be met unless we have specifically confirmed this. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability.
